This Privacy Policy is intended to explain the types of information Jockey collects about you when you visit a Jockey Site or retail location, how the information is used, how you can access and update your information, and the security measures Jockey has in place to protect the information.

What Information Does Jockey Collect & How Is It Collected?

If you choose not to provide information, Jockey may not be able to provide you with requested products, services or information.

How Do We Collect Your Information:

Information You Provide

Jockey collects information you enter on our Site or on other Jockey digital properties (including information collected when placing an order or joining the Jockey Rewards® program). In addition, Jockey collects information you provide in Jockey stores, when you sign up for Jockey Rewards® program, when you contact Jockey Consumer Care representatives and when you contact Jockey by other means (including, on social media, via online marketplaces and via letter). Jockey may collect or ask you to provide certain types of information (including personal information) when you:

  • Create or update a personal account on Jockey.com
  • Visit a Jockey owned and operated retail location
  • Join the Jockey Rewards® program (See also Jockey Rewards Terms and Conditions)
  • Shop online or check the status of a purchase order
  • Sign up to receive SMS and/or email communications from Jockey on products and promotions
  • Participate in a contest, sweepstake, giveaway or other similar type of product promotion
  • Participate in marketing or product surveys
  • Participate in Jockey sponsored sales events
  • Provide product reviews or other comments on Jockey digital properties
  • Purchase/Return/Exchange Jockey products
  • Post on Jockey social media pages
  • Contact Jockey Consumer Care (by phone, email, letter or though other means)

Navigational Information
Each time you visit the Site or any other Jockey owned and operated website, navigational information may be automatically collected. Navigational information includes your domain name/type, internet service provider, internet protocol address and browser, and site preferences. The navigational information tells us about your visit and other users' visits to our Site, including aggregate information on what web pages were most visited, the time a user last visited our Site, and the technical efficiencies of our Site and services, such as, the time it takes a visitor to connect to our Site. We use this information to better understand your experience with our Site, to enhance its content and services, and to deliver improved features, services and products for your convenience. This helps allow us to provide you with a more personalized experience regardless of how you interact with Jockey (i.e. online, in store, mobile, etc.).

Automated Information Collection
Jockey and our service providers use anonymous identifiers such as cookies and other technologies to collect and store certain types of information whenever you interact with Jockey. The types of information collected from these anonymous identifiers include click stream information, browser type, time and date, subject of advertisements/links clicked or scrolled over, hardware/software information, cookie and session ID). We also may allow third-party companies to place tags on our digital properties. The tags may collect information from your interactions on Jockey.com Jockey's Privacy Policy does not cover these third-party companies. You can contact such third-party companies directly for more information about their privacy policy and your choices regarding the tags and information collected by the tags.

Social Media Widgets
Jockey's sites (including this Site) and mobile application(s) may include social media features, such as the Facebook, Pinterest, and Twitter widgets. These features may collect information about you such as your IP address and which page you are visiting on our Site. They may set a cookie or employ other tracking technologies to accomplish this. Social media features and widgets may be hosted by a third-party. Your interactions with those features are governed by the privacy policies of the companies that provide them.

Mobile Location Information
If you use a mobile device, your device may share location information (when you enable location services) with our websites (including this Site), mobile application(s), services or our service providers.

Cameras
We may use cameras in and around Jockey retail stores for operational purposes such as measuring traffic patterns and tracking in-stock levels. Cameras may also be used for fraud detection, theft prevention and security.

Information From Other Sources
Jockey collects information about you from other sources to enhance our existing information about you and to improve the accuracy of our records. This improves our ability to contact you and increases the relevance of our marketing.

How Does Jockey Use Personal Information?

Jockey uses the personal information you provide to us and that we obtain about you, as detailed above, for a variety of purposes such as: to communicate with you, to process transactions, to deliver products and services that you ordered, to fulfill your requests and respond to your inquiries, to help Jockey Consumer Care representatives resolve any issues you may have, to identify fraud, for verification purposes, to improve Jockey's services, for analysis purposes, and to provide you with information about our products, services and the Site. Jockey may also use the personal information to determine products and services which may be of interest to you or your household, and to communicate with you. Jockey uses such information to improve your experience by delivering more personalized interactions and advertising in digital and social media.

Jockey's Purposes For Using Your Information:

Product and Order Fulfillment

  • Fulfill and manage purchases, orders, payments, and returns/exchanges
  • Respond to requests for information about Jockey products and services in our stores, on our websites (including this Site) or mobile application(s) or to otherwise serve you
  • Connect with you on social media or internet chat platforms. Chat functionality may allow our Consumer Care representatives to see what you are typing before hitting the send button. This allows for quicker response time as our Consumer Care representatives anticipate questions
  • Administer the Jockey Rewards® program
  • Administer sweepstakes, giveaways and contests
  • Verify and process warranty claims
  • Allow you to search for products, check prices, provide product ratings and reviews, track your orders, scan a UPC barcode or QR code, update information, etc.
  • Legal and regulatory compliance
  • Perform other business activities as needed, or as described elsewhere in this policy

Marketing and Experience Improvement

  • Deliver coupons, mobile offers, emails, mobile messages, targeted advertising and social media notifications
  • Provide interactive features of the Site or mobile application(s), such as product reviews, send marketing communications and other information regarding products, services and promotions

How Does Jockey Use Cookies and Interest-Based Advertising Analytics?

The Site utilizes “cookies” and third-party interest-based advertising analytics, including GOOGLE Analytics, Google AdWords, and Google Display Network. Such information is non-identifiable, aggregate demographic information, for example, age, gender, interests. Cookies and interest-based information help us to improve your overall experience with the Site, provide you with a more personalized shopping experience and enable you to fully interact with and complete your transaction on the Site. You may decline the use of cookies if your browser permits; however, doing so may limit the functionality of some of our sites or services.

The Site also uses tracking pixels. Tracking pixels are small graphic images used to track activity on web pages or to confirm receipt of emails. They help Jockey to determine user activity on our Site and provide you with a more personalized experience.

Jockey also uses third-party cookies to provide you with Jockey advertisements and promotions on other internet sites and in direct mail. How Does Jockey Protect Your Information?

Jockey is committed to protecting your information. We have established industry standard administrative, technical, and physical safeguards to help ensure that only authorized members of our workforce with a valid business need are granted access to information supplied by customers. Other controls we use include, but are not limited to, authentication mechanisms, firewalls, antivirus software, and encryption technologies for transferring consumer data with our Site. Jockey also requires its vendors and partners to abide by its policies and procedures related to the proper handling of customers' personal information. Additionally, Jockey performs periodic security reviews to help ensure that unauthorized individuals do not have access to your personal information. However, no e-commerce solution, website, mobile application, database or system is completely secure or “hacker proof.” You are also responsible for taking reasonable steps to protect your personal information against unauthorized disclosure or misuse.

Generally, Jockey keeps your personal information only if it is reasonably necessary to fulfill the purpose for which it was collected. In some cases, Jockey is required by law to keep your personal information for a specified period. For example, where information is collected for transactions such as purchases, returns, exchanges, refunds, and warranty claims, Jockey is required to retain this information based on regulatory, legal and statutory requirements.

What Information Does Jockey Share

Jockey shares the information we collect with Jockey's various wholly owned subsidiaries to improve customer experience across Jockey companies. In addition, Jockey uses reputable third-parties to help us provide services to you such as:

  • Fulfilling orders
  • Processing payments
  • Monitoring site activity
  • Conducting surveys
  • Maintaining the Jockey Rewards® program
  • Administering emails
  • Drafting, printing and administering online and paper (i.e. catalogs, mailers flyers) marketing campaigns

  • Providing analytics and analysis

We limit information shared with service providers to what is necessary to fulfill the services.

Jockey may also share nonidentifiable or aggregate information with third parties that monitor consumer purchasing trends and product interest or for any other lawful purpose. Third parties also provide aggregate, comparative information on the performance of the Site to us. In addition, Jockey cooperates in advertising member networks and data cooperatives with other consumer entities where Jockey may share your personal information such as name, postal address and general purchase information for marketing / commercial purposes. These advertising networks and co-ops may inform you about products or services that might interest you. To the extent this Site or Jockey's social media pages contain links to outside services and resources, the availability and content of which Jockey does not control, any concerns regarding any such service or resource, or any link thereto, should be directed to the outside service or resource. This Privacy Policy does not apply to any outside services or resources. California Privacy Rights

What are your California Privacy Rights?

If you are a California resident, the information below also applies to you. Certain terms in this section have the meanings given to them in the California Consumer Privacy Act (“CCPA”). Under the CCPA (as amended), customers of Jockey who are residents of California have the right to request the following for the preceding 12 months:

    • Characteristics of protected classifications (e.g., gender, age)

Do Not Share / Sell my Personal Information/Right to Opt-Out. You have a right to opt-out from future sharing or “sales” of personal information. You can exercise your Do Not Share / Sell My Personal Information rights by contacting us using the methods above or making your request via our “Do Not Share / Sell My Personal Information” button on the Site.

To exercise the rights listed in this section, a California consumer may designate an authorized agent to make a request to access or delete information. Jockey will take the appropriate steps to verify the authorization of the agent and may request written documentation evidencing the consumer's consent to the representation. An authorized agent will be subject to the same verification procedures noted elsewhere in this section.

Nondiscrimination
Exercising your rights to request access to the information kept about you, or a request to delete such information, will not result in any increased costs or other discriminatory actions. Jockey may keep certain pieces of information after a verified request for deletion where required to do so under applicable laws.

California Resident Verification
You will be required to submit 4 pieces of information including your name, address, email, and phone number when making a request under the CCPA. Jockey will use this information to search our systems and determine if we have information about you. If we are able to locate information about you, we will fulfill your access and/or deletion request. Jockey will ensure that such information is provided to you in an easily accessible format and will be provided free of charge unless access fees are allowed by law. If we are not able to match all 4 pieces of information you submit, we may not be able to fulfill your request, in which case, this Privacy Policy outlines the categories of personal information we collect, use, disclose, and share as provided in more detail above. In addition, Jockey may require additional verification to the extent permitted by law. Verification may consist of any combination of the following inquiries by Jockey: 1) a description of recent order history; 2) login information for a Jockey account, if one exists; 3) general information such as a billing or shipping address matching Jockey records; or, 4) any other methods necessary and appropriate to determine the validity of the access request.

If you are an authorized agent making a request on the behalf of another individual, you will be required to submit your name, address, email, and phone number as well as the name, address, email and phone number of the individual you are making a request on behalf of. As an authorized agent you will be required to fill out a certification form confirming your information and certifying you have the right to make this request on behalf of such individual.

Financial Incentives
Participation in the Jockey Rewards® program requires Jockey to retain certain categories of personal information, of the type noted elsewhere in this Policy (see also Jockey Rewards Terms and Conditions for more information). If a California resident requests the deletion of all personal information in Jockey's possession, the resident may not be able to participate in the Jockey Rewards® program and receive financial incentives in the form of receiving points based upon purchases which can be used to discount the price of future purchases unless such information is recollected and stored with their authorization.

California Minors
If you are a California resident under 18 years old and a registered user, you can request that we remove content or information that you have posted to the Site or other online services. Note that fulfilment of the request may not ensure complete or comprehensive removal (e.g., if the content or information has been reposted by another user). NEVADA PRIVACY RIGHTS

  • If you have created a Jockey.com account, you can log in to review and update your account information, including contact, billing, and shipping information.

We will provide you the personal information requested if reasonably available, or will describe the types of personal information we typically collect.

 

Virginia Privacy Rights

What are your Virginia Privacy Rights?
If you are a Virginia resident, the information below also applies to you. Under the Virginia Consumer Data Protection Act (“VCDPA”), customers of Jockey who are residents of Virginia have the right to request the following for the preceding 12 months:

  • To confirm whether Jockey is processing the consumer's personal data and to access such personal data
  • To correct inaccuracies in the consumer's personal data, taking into account the nature of the personal data and the purposes of the processing of the consumer's personal data
  • To delete personal data provided by or obtained about the consumer.
  • To obtain a copy of the consumer's personal data that the consumer previously provided to Jockey
  • To opt-out of the processing of the personal data for purposes of (i) targeted advertising, (ii) the sale of personal data, or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer

Jockey complies with the Personal Information Protection and Electronic Documents Act, which allows Canadian residents access to information regarding the existence, use and disclosure of personal information. Children's Information Policy

Websites owned and operated by Jockey are intended for individuals age 13 or over. Like you, we are concerned about the safety of children when they use the Internet. Consistent with the Children's Online Privacy Protection Act of 1998, we will never knowingly request personally identifiable information from anyone under the age of 13. If we become aware that a subscriber is under the age of 13 and has registered, we will remove his or her personally identifiable registration information from our files. We do not knowingly share the personal information of minors who are at least age 13 and under 16 years of age unless they affirmatively authorize the sharing of data. We value all of our customers, however, parents or guardians must place orders from Jockey for their children.

Updates to the Privacy Policy

This Privacy Policy is effective as of the date noted above. We may need to change our Privacy Policy from time to time because of Site updates or upgrades, changes in Site administration or technology advances or due to changes in laws or regulations. We therefore reserve the right, at our sole discretion, to change, modify, add, or remove portions of this Privacy Policy at any time.
