BY ENTERING THE SWEEPSTAKES, YOU AGREE TO THESE OFFICIAL RULES, WHICH FORM A CONTRACT. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITY OBLIGATIONS ON THE PART OF ENTRANT AND A LIMITATION OF ENTRANT'S RIGHTS AND REMEDIES.
You understand that you are providing your information to Jockey International, Inc. (“Jockey”) and not to Instagram and Facebook. The information you provide will only be used in marketing as it directly relates to Jockey. The Sweepstakes is in no way sponsored, endorsed or administered by or associated with Instagram and Facebook. Information collected in this Sweepstakes will be used in accordance with the Sponsor’s privacy policy which may be viewed at Jockey.com/customerservice/privacypolicy. By participating in this Sweepstakes, you hereby agree to Sponsor's collection and usage of your personal information and acknowledge that you have read and accepted Sponsor's privacy policy.
1. Eligibility:
Jockey® Hangin’ with the Crew V.I.P. Track Experience Sweepstakes (“Sweepstakes”) is open only to legal residents of the United States and the District of Columbia who are at least nineteen (19) years old or the age of majority in the State of his/her residence, whichever is older, at the time of entry. Employees, officers, directors and agents of Jockey International, Inc. (“Sponsor”), and their respective parents, subsidiaries, affiliate companies and advertising and promotion agencies and prize suppliers (collectively, “Released Parties”), as well as the immediate family (spouse, parents, siblings, and children and their respective spouses, regardless of where they reside) and household members of each such employee, whether or not related, are not eligible. The Sweepstakes is subject to all applicable federal, state, and local laws, and regulations. Void outside of the U.S. and where prohibited by law.

3. Agreement to Official Rules:
Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. By submitting an entry, you irrevocably assign to Sponsor all right, title, and interest in your entry in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all uses thereof, including, without limitation, for purposes of advertising or trade. The rights granted under this paragraph shall extend to all entries and all other submitted materials related to the Sweepstakes, including those submitted by non-winners and the winner. By submitting an entry, you grant to Sponsor and its affiliated companies, the right, except where prohibited by law, to use your entry, first name and last initial, likeness, picture, address (city and state only), and written statements. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use of your entry. The rights granted under this paragraph shall extend to Sponsor and its affiliated companies with respect to all Entrants in the Sweepstakes, including non-winners and the winner. Released Parties are not responsible for any unauthorized third-party use of any entry. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to entrants.
4. Timing:
Sweepstakes begins Wednesday, August 31, 2022 at 12:00:01 a.m. Central Time (“CT”) and ends Sunday, September 11, 2022 at 11:59:59 p.m. CT ("Sweepstakes Period"). Entries received outside the Sweepstakes Period will be void. Sponsor is the official timekeeper for this Sweepstakes. (b) Winner Selection and Notification: There will be one drawing to award one (1) prize. Potential winner will be randomly selected by the Sponsor on or about Friday, September 16, 2022 (“Drawing Date”) from all eligible entries received during the Sweepstakes Period.Subject to verification and compliance with the Official Rules, potential winner will be contacted by the Sponsor by email or Direct Message on the social media platform Eligible Entry was submitted with instructions on how to claim their prize. Potential winner will be notified within two (2) business days of the completion of the Sweepstakes Drawing Date. Once eligibility has been verified and the Sponsor receives the required information, the Sponsor will arrange to award the prize. Sponsor shall have no liability for any notification (if any) or delivery that is lost, intercepted, returned, refused or not received for any reason. If prize is returned as unclaimed or undeliverable, such potential winner will forfeit prize and at Sponsor’s sole discretion, an alternate potential winner may be selected. If any potential winner is found to be ineligible or if a potential winner has not complied with these Official Rules or declines a prize for any reason, such potential winner will be disqualified and at Sponsor’s sole discretion, an alternate potential winner may be selected.
Earned points will be awarded to orders after all discounts and/or rewards have been applied. Points earned in a transaction cannot be used on the transaction they were earned and will be available for a future purchase.
5. Prize/Approximate Retail Value (“ARV”):
One (1) winner will receive a V.I.P. Track Experience with the Trackhouse Racing team for two (2) at the Talladega Superspeedway race in Lincoln, Alabama on October 2, 2022 (“Prize Package”). Prize Package will consist of:

Sponsor will not replace any lost, mutilated, undeliverable, returned, refused or stolen prize. Prize is non-transferable, non-refundable, and no substitutions will be made. Prize is not redeemable for cash. Sponsor reserves the right to substitute a particular prize for one of comparable or greater value. Winner is responsible for any and all applicable local, state, and/or federal taxes and fees. Please allow up to six (6) weeks for delivery of any prize.

Winner is responsible for any and all applicable local, state, and/or federal taxes and fees, and any other costs and expenses not specified herein as being awarded. Winner is solely responsible for arrangement of all travel transportation, hotel incidental charges, gratuities, food and beverages, and any other expenses for collecting prize and/or race attendance. Furthermore, Prize Package does not include tickets to the Grandstand seating. If winner prefers to watch race from the Grandstand, winner will be responsible for purchase of any Grandstand seating tickets. Winner and their guest must sign and return a liability and publicity release as instructed by the Sponsor. Failure to sign release, may result in a winner’s disqualification and the forfeiture of his or her interest in the prize. Once winner’s guest has been selected, they may not be substituted, expect in Sponsor’s sole and absolute discretion. Winner and guest are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance.
Sponsor to determine final section and seat location at its sole discretion. Winner may be required to pick up the winning tickets at the Talladega Superspeedway will call box and must have a valid picture ID to claim the prize. Time, date and location herein for NASCAR 2022 Yellawood 500 race are subject to change and cancellation outside of Sponsor’s control. If the NASCAR 2022 Yellawood 500 race is canceled, suspended, not completed or not raced for any reason, Sponsor has no further obligation to the Winner to replace or substitute race and/or prize.
Odds: Odds of winning depend on the number of eligible entries received during the Sweepstakes Period.
Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any prize furnished in connection with the Sweepstakes. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSORS HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.

During the Promotion period, you may enter this Promotion following the entry details below.
Visit Instagram: follow @jockey on Instagram, Like one of our Instagram post about the Sweepstakes, Share one of our post to your stories which must include the text overlay #Sweepstakes and mention @Jockey, and visit jockey.com/raceexperience to complete the Sweepstakes registration form with all required information (full name, valid email address, age confirmation), agreement to the Official Rules and submit (“Entry”). After you have followed Jockey on Instagram, Liked and shared our post, and submitted your registration, you will automatically be entered into the Sweepstakes. LIMIT: One (1) entry per person. Instagram's and Facebook’s terms of use (Instagram.com/about/legal/terms/) apply.
Limit: You may enter one (1) Eligible Entry during the Sweepstakes Period. Entries in excess of any stated limitation and entries generated by script, macro, or other automated means or any means that subvert the entry process will be void.

Alternate Means of Entry (“AMOE”): Visit Sponsor’s Site at jockey.com/raceexperience and complete entry form with all required information (full name, valid email address, etc.) and submit during the Sweepstakes Period. Your entry will be included in the Sweepstakes drawing. Your entry will be included in the Sweepstakes drawing. All AMOE entries must be received by Sunday, September 11, 2022 at 11:59:59 p.m. CT. Sponsor is not responsible for lost, late, mutilated, misdirected, incomplete, or inaccurate entries.
7. Submission Restrictions:
Entrant must not include any of the following content in any Entry: (a) any individuals in Eligible Photo who does not consent to the use of their likeness in Sweepstakes entry; (b) pornography, adult-orientated content or any other sexually-explicit material; (c) materials related to lotteries or gambling; (d) explicit language or content, images of violence, or promotion of illegal activities; (e) content in the violation of intellectual property rights of others including trademark, copyright, patent, trade secret, publicity or privacy right; (f) libelous, defamatory, disparaging, tortious, or slanderous materials; (g) content that denigrates, disparages, reflects negatively on or communicates messages or images inconsistent with the positive images and/or good will to which the Sponsor wishes to associate; (h) promotes alcohol, illegal drugs, tobacco, firearms/weapons or promotes any activities that may appear unsafe or dangerous; (i) promotes any particular political agenda or message; (j) material that promotes racism, bigotry, hatred or harm against any group or individual that promotes discrimination based on race, sex, religion, nationality, disability, age, sexual orientation or any other class protected by law; (k) appears to duplicate any other submission; (l) defames, misrepresents or contains disparaging remarks about other people or companies; (m) or contains materials that violates any law or regulation. An Entry that does not comply with the foregoing, in the sole discretion of Sponsor, will be disqualified and eliminated from consideration.
8. Winner Requirements:
: Acceptance of prize shall constitute winner’s irrevocable agreement and consent to Sponsor’s and its designees’ use of winner’s name, city, state, likeness, photo and/or prize information in connection with this Sweepstakes for promotional, advertising or other purposes, in any manner, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.
9. Drawing/Entry Dates:
A random drawing will be conducted on or about Friday, September 16, 2022 from all eligible entries received in accordance with the entry end date and time set forth in these Official Rules. Conduct of the Sweepstakes and the drawings are under the supervision of the Sponsor.10. Release of Liability / Conditions of Participation.
A. Transmission of Information. Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in this Sweepstakes; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or this Sweepstakes; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of this Sweepstakes, the uploading, the processing or random selection of entries, the announcement of the prizes or in any Sweepstakes-related materials; (5) late, lost, garbled, misdirected, inaccurate, incorrect, undeliverable, damaged or stolen entries or mail; (6) costs associated with claiming or redeeming the prizes; nor (7) loss or damages resulting from an entrant’s connection to the internet via any of the websites contained herein. Released Parties are not responsible for any incorrect, mistranscribed, misdirected or undeliverable entries, E-mail transmissions, incorrect announcements of any kind, or for any technical problems of any kind, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor assumes no responsibility for late, lost, incomplete, inaccurate or damaged entries, or undeliverable E-mails resulting from any form of active or passive E-mail filtering by a user's Internet service provider and/or E-mail client or for insufficient space in user's E-mail account to receive E-mail. Sponsor does not accept responsibility for any damage (whether material or non-material) caused to entrants, to their computer equipment or to data which is stored on them, or to their personal, professional or commercial activities. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor.
B. Fraud; Reservation of Rights. Sponsor reserves the right to cancel, suspend, and/or modify this Sweepstakes, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of this Sweepstakes, as determined by Sponsor in its sole discretion. If terminated, Sponsor may, in its sole discretion, determine winner from among all non-suspect, eligible entries received up to time of such action or as otherwise deemed fair and appropriate by Sponsor. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of this Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all associated entries. The preceding in no way precludes Sponsor from taking other actions against such individuals so as to protect its rights. Sponsor’s failure to enforce any provision of these Official Rules in a given circumstance does not constitute the waiver of such provision.
C. Release and Indemnity. By participating, entrant indemnifies, releases and agrees to hold harmless the Released Parties, their parents, affiliates and subsidiaries, and other entities involved in the development/production/administration of the Sweepstakes, and the directors, officers, agents, representatives, shareholders, employees, successors and assigns of any of the above organizations, from any and all liability for loss, harm, damage, injury, cost or expense whatsoever, including without limitation, property damage, personal injury (including emotional distress), and/or death, arising from participating in the Sweepstakes, any Sweepstakes-related activity and/or acceptance, receipt, possession or use/misuse of any prize and for any claims or causes of action based on publicity rights, defamation or invasion of privacy and merchandise delivery.
11. FORCE MAJEURE.
If, for any reason, the Sweepstakes (or any part thereof) is not capable of running as planned by reason of computer virus, bug, system malfunction, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other natural cataclysm, riot, strike, civil commotion, governmental regulation, global pandemic or any other causes beyond the control of Sponsor which, in its sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (or any part thereof), Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and conduct the Sweepstakes selecting the prize winner(s) for the Sweepstakes Period drawing from among all eligible entries received for such Sweepstakes Period drawing prior to the action taken by Sponsor or otherwise in a manner which is fair, equitable and in accordance with these Official Rules, as determined by Sponsor in its sole discretion. Notice of such action by Sponsor will be posted on the official Sweepstakes microsite.
12. DISPUTE RESOLUTION/GOVERNING LAW.
Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state court in Milwaukee, Wisconsin; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) unless otherwise prohibited, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion shall be governed by, and construed in accordance with, the laws of the State of Wisconsin, without giving effect to any choice of law or conflict of law rules (whether of State of Wisconsin or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Wisconsin.
